The Moms Club Terms of Service

By joining The Moms Club ("TMC"), renewing your membership,  or using www.themomsclub.net website or chat group (listserve) services, you acknowledge and agree that the TMC roster or any other list (paper or electronic) produced by TMC is for the personal reference of its members. Using the roster for solicitation, electronic or in print, is prohibited. Violation of this policy will jeopardize your membership. We appreciate your cooperation with the TMC policy on appropriate use of the roster, which is designed to protect the privacy of our members.

By joining The Moms Club ("TMC"), renewing your membership,  or using www.themomsclub.net website or chat group (listserve) services, you acknowledge that your child(ren) and you desire to participate in The Moms Club (“TMC”) functions, parties, and/or activities.

You further understand that:

• TMC does not require that you or your child(ren) participate in any of its functions.
• All activities sponsored or conducted by The Moms Club take place in an active environment that may be hazardous, and may possibly result in accident, loss, damage, injury or fatal injury to yourself or your family, including your children.
• You are aware that during any activity in which yourself or your family members are participating under the arrangement of TMC, its agents, employees and associates, certain substantial risks and dangers may inevitably occur, including but not limited to injury or fatal injury resulting from the hazards of traveling to and/or participating in any activity, possibly without nearby medical facilities, the forces of nature, and travel by automobile, bus or other conveyance.
• TMC requires you to be responsible for the safety and conduct of myself, your family members, and your guests, while involved in any functions.
• Similarly, TMC requires all other members to be responsible for themselves and their family’s safety and conduct.

Therefore, you agree as follows:

In consideration of and as part my membership in, and for the right to participate in any activity, services, and food, if any, arranged for me by The Moms Club, its agents, employees, and associates, and with full knowledge of the aforementioned dangers, and intending to be legally bound, I hereby agree for myself and on behalf of all of my family and heirs to RELEASE The Moms Club and any of its representatives, agents, directors, officers, members, trip coordinators, and fellow members, from any and all liability, claims, demands or any causes of action, and not to sue or otherwise make any claim against TMC or any of its representatives, agents, directors, officers, members, trip coordinators, or fellow whatsoever which may arise during my or my family members’ participation in any activities of the TMC. This RELEASE AND WAIVER has no expiration date.

I also agree to INDEMNIFY AND HOLD THE RELEASED PARTIES HARMLESS from all claims, judgments, expenses and costs, including but not limited to attorney's fees, incurred in connection with any claims brought as a result of my or any member of my family’s participation in TMC activities and which are released by the terms of this agreement.

I intend this RELEASE OF LIABILITY to be effective whether or not any accident, loss, damage, injury or death RESULTS FROM THE NEGLIGENCE of the TMC or any of its representatives, agents, directors, officers, members, trip coordinators, or fellow members. I understand that negligence means a failure to do an act which a reasonably careful person would do, or the doing of an act which a reasonably careful person would not do, under the same or similar circumstances, to protect himself or herself, or others, from accident, injury or death.
